REGULATIONS of the online store: www.primavera-home.com


I. General Provisions

  1. The online store located at www.primavera-casa.eu, hereinafter referred to as the e-store, enables you to make purchases via the Internet.
  2. The owner and seller of the primavera-home e-store is PRIMAVERA HOME Sp. z o.o. Spółka Komandytowo-Akcyjna ul. Kłobucka 23 B lok.U1, 02-699 Warsaw, NIP: 5372642157 REGON: 380322806 (hereinafter referred to as the Seller)
  3. The Buyer may submit complaints to the following address: PRIMAVERA HOME Sp. z o.o.   4. The Seller offers the goods presented in the e-shop at the prices specified in the price list and according to the following principles.
  5. The Buyer is a natural person, a legal person, or an organizational unit without legal personality who has registered their order and paid the fee specified in the price list, and has consented, within the meaning of the Personal Data Protection Act (consolidated text - Journal of Laws of 2002, No. 101, item 926, as amended), to the processing of their personal data contained in the order form for the purposes of using the e-shop and, if applicable, for marketing purposes related to its operation.
  6. The Consumer is a natural person entering into a legal transaction with an entrepreneur that is not directly related to its business or professional activity.
  7. The Seller declares that it conducts its business in accordance with good practices and in a manner that does not distort or is likely to distort the market behavior of the average consumer before, during, or after the conclusion of a product contract.

II. Conclusion of the contract (making purchases)

  1. Orders can be placed 24 hours a day, all year round, through the shopping system that is an integral part of the e-store, or by phone from Monday to Friday between 10:00 AM and 6:00 PM.
  2. Orders placed on weekdays after 2:00 PM, on Saturdays, Sundays, and on public holidays will be processed the next business day.
  3. A necessary condition for concluding a contract and fulfilling an order is the provision of all data required in the order form.
  4. The Seller reserves the right to withdraw from fulfilling the order in the event of any irregularities in the order necessary for shipping (in particular, incorrectly provided personal or contact information). In the case of shipments paid by bank transfer, this restriction requires a prior, full refund of the payment made to the Buyer, at the Seller's expense, to the account from which the transfer was made.
  5. To place an order, the Buyer may place an order or complete a one-time registration as an e-shop user. This registration is free of charge. The Seller undertakes to protect personal data in accordance with the Act of August 29, 1997, "On Personal Data Protection, consolidated text - Journal of Laws of 2002, No. 101, item 926, as amended)." The Buyer has the right to access their user account data at any time, in particular their own personal data, to correct it, and to request its discontinuation and deletion. The Seller may contact the Buyer in connection with the placed order, in particular to verify the order. This verification will be carried out before the order is processed. This verification includes, in particular, telephone calls or email correspondence with the Buyer to confirm the order's accuracy. Contact is at the expense of the Seller.
  6. The Seller informs the Buyer about the ordered goods before sending the order.


III. Price and payment terms

  1. The order entails an obligation to pay; the payment includes the price of the goods and delivery costs.
  2. The price of the goods results from the online store's offer and the content of the order placed by the Buyer in accordance with the price list applicable in the online store.
  3. The Buyer has the option of paying for the purchased goods via bank transfer - prepayment, payment card, eTransfer, or cash on delivery. The entity providing online payment services for fast transfers is PayPro S.A. Visa and Mastercard payment cards are accepted.
  4. When making a transfer, it is essential to include the order number provided in the confirmation in the transfer description. This is a necessary condition for order fulfillment. If this number is not met, the Seller will attempt to obtain this number from the Buyer. If the payment cannot be identified, the amount will be refunded to the Buyer's account within 7 (seven) days, and the related order will be considered invalid and canceled.

  6. The price of the goods includes all fees related to the introduction of the goods, which means that the offered price is the gross price of the goods expressed in PLN (delivery costs are specified in Chapter V of the Terms and Conditions).
  7. A receipt is a standard document confirming the purchase.
  8. A VAT invoice is issued to companies and private individuals at the request of the Buyer.
  9. The Seller is no longer bound by the Buyer's order placed in the prepayment system if payment (payment by bank transfer or card) is not received in the indicated account within 14 days from the date of sending the order confirmation email.
  10. Promotional offers cannot be combined.
  11. The personal pickup shipping method for purchased furniture is available at the PRIMAVERA HOME branch

IV. Terms of order fulfillment and delivery

  1. In the case of orders paid by bank transfer, payment card, or e-payment, the Seller will begin fulfilling the order immediately after receiving payment for the order, and in the case of payment by cash on delivery, immediately after receiving the order.
  2. The Buyer cannot modify the order parameters after its prior acceptance.
  3. Delivery will be made via a courier company or other shipping company indicated by the Seller. The order fulfillment time is counted from the moment payment is received.
  4. The order fulfillment time does not exceed 35 business days, unless a different time is specified in the Product description or when placing the order. In the event of temporary or permanent unavailability of a product, the Buyer will be informed immediately. If the order consists of Products with different fulfillment times, the order will be shipped to the Buyer according to the longest time specified in the order. After prior arrangement with the Seller, it is possible to partially fulfill an order for individual products. The Seller is not responsible for delays in production or transport resulting from unforeseen circumstances beyond its control. The purchased goods will be shipped to the address provided by the Buyer in the order form – the place of fulfillment. The ordered Products will be delivered to the Buyer by a transport company or courier. Products delivered by courier are delivered Monday through Friday during the hours appropriate for the specific courier company. To arrange delivery details, the courier may contact the Buyer by phone (including text messages). We do not guarantee that the courier will deliver the goods at the time specified by the Buyer in the order.
  5. The courier or other carrier is obligated to unload all shipments from the vehicle. The transport price does not include the service of carrying the furniture.
  6. If the shipment cannot be collected on the specified date, the Seller may charge additional costs for re-shipping or storing the ordered product.
  7. Before accepting the shipment from the courier, please check the packaging for any signs of damage caused during transport. If the packaging is damaged, do not accept the shipment. Please complete a damage report in the presence of the courier and contact the Customer Service Department as soon as possible to resolve the matter. The completed damage report forms the basis for further complaint processing.

V. Delivery Cost

  1. The delivery cost will be provided for the Buyer's approval at the ordering stage.
  2. The individual delivery cost will depend on the weight and dimensions of the shipment, as well as the distance to the delivery location and the payment method. The fee amount will be made available to the Buyer for their information each time - before the order is confirmed.
  3. The fee related to delivery and payment processing in the amount specified in the order is covered by the Buyer, unless the Seller decides, pursuant to a promotional offer, to exempt the Buyer from the need to pay such fee in whole or in part - information about the promotional offer will be communicated to the Buyer before the order is confirmed.
  4. The delivery cost is a separate item on the order and the settlement document (invoice or receipt) issued by the Seller to the Buyer and will constitute part of the total value of the order.
  5. The delivery cost outside Poland is determined will be individually managed with e-shop support.

 

VI. Complaints

 

  1. The rights of the Buyer, who is a consumer, arising from the provisions of this section are independent of the rights granted under the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827).
  2. If the Buyer discovers qualitative or quantitative defects in the purchased goods, they should contact the online store to determine how to resolve the complaint as quickly as possible.
  3. Differences in the shade of fabric, leather, eco-leather, wood, laminated board, conglomerate, or steel elements resulting from different monitor or graphics card settings do not constitute grounds for filing a complaint. The photos presented on the Store's website are for illustrative purposes only; fabrics and colors may differ slightly from those available. The actual color of natural wood may differ from the product photo. Additionally, the Seller reserves the right to the possibility of structural and color differences in materials and raw materials (e.g. conglomerate) from different beams and production batches, as well as differences between the offered fabric sample and the fabric obtained in production. These differences are due to the natural dyeing process and are beyond the Seller's control.
  4. If the Buyer orders additional furniture upholstered in the same color as the furniture already purchased, there may be a difference in the shade of the selected fabric, which does not constitute a basis for a product complaint.
    If the Buyer orders additional wallpaper of the same color and pattern, there may be a difference in the shade and size of the pattern, which does not constitute a basis for a product complaint.
  5. In furniture with a built-in sleeping function, there may be a noticeable difference in the hardness of the seat and the positioning of the seat cushions.
    This may be visible immediately upon purchase, or may appear after some time of using the furniture.
    This is caused by the different surfaces on which the seat is placed (the sleeping function occupies part of the seat and is a movable and functional part. The remaining part of the seat is stationary), This is a defect and is not subject to warranty claims.
  6. Tables with a composite or glass top and a steel base should not be moved by lifting them upwards by grasping the top. This may result in the removal of mounting elements and damage to the top or base. This is not subject to warranty claims. It is recommended to move the table by grasping the base at the lowest possible point.
  7. Conglomerate, lacquered, and glass countertops are not scratch-resistant. We recommend caution when using them, e.g., pads. Care should be taken with a damp cloth and mild cleaning agents. Scrubbing or using aggressive chemicals may dull the surface. This is not subject to warranty claims. Conglomerate countertops are coated with epoxy resin and are not temperature-resistant. They should not be exposed to direct contact with hot tableware or sunlight. This may cause discoloration, which is not subject to warranty claims.
  8. Galvanized lighting and furniture elements should be cleaned very carefully with a soft, dry cloth. Scrubbing or using water or other liquids may cause discoloration. This is not subject to warranty claims.
  9. The Buyer can download the complaint form from the online store. Complete all fields and then return it by email. The Buyer also has the right to submit a complaint in writing or by email.

  11. The Seller will collect the goods from the Buyer at its own expense via a courier company.
  12. If the complaint is found to be justified, the goods will be replaced with another, full-value product, and if this is no longer possible, the Buyer will be refunded. In the case of payment by card, the refund will be made to the payment card account used for payment.
  13. The Seller will consider the complaint within 14 days of its receipt.
  14. Product dimensions provided in the online store may differ from the actual dimensions by +/- 4cm, which is due to technological processes. Rights due to quality defects expire:

a) within the period specified on the warranty card if such a card was delivered with the goods - information about the warranty duration and a link to the document or subpage containing information regarding the warranty content included in the product card on the store's website.

b) in the case of warranty, within two years from the date of delivery of the goods.

c) Rights due to quantitative defects should be reported immediately upon receipt of the shipment.

15. If the buyer is a Consumer and a physical defect is discovered within one year from the date of delivery of the sold item, it is presumed that the defect or its cause existed at the time of delivery of the item to the Consumer or the carrier indicated by the Consumer.

17. ATTENTION! IMPORTANT INFORMATION! MIRROR FURNITURE DUE TO THE COMBINATION OF DIFFERENT MATERIALS (WOOD, PLYWOOD, MDF BOARD, MIRROR, GLASS) WE INFORM: Due to the high temperature variations, it is recommended to store the furniture in an adaptation room in winter to avoid thermal shock. Rooms in which the furniture is used should be regularly ventilated (except during winter) and the relative air humidity maintained at a constant required level of 45% - 60% at an air temperature of 18°C -24°C. During the winter (heating) period, it is absolutely necessary to use air humidifiers to maintain the required relative air humidity, as this is a condition of the warranty.

VII. Buyer-Consumer Rights: Withdrawal from the contract and return of goods

  1. If the Buyer wishes to withdraw from the contract and return the goods, they may contact the online store to determine how to return the goods.
  2. Packages sent to the Seller's address via cash on delivery will not be accepted.
  3. Pursuant to the Act of May 30, 2014, on Consumer Rights (Journal of Laws of 2014, item 827), the Buyer may withdraw from the contract concluded with the Seller without giving any reason within 14 (fourteen) days from the date of receipt of the shipment. To meet the deadline, it is sufficient to send a declaration before its expiry (this does not apply to the products specified in point 5).
  4. The Buyer does not have the right to withdraw from a distance contract in the case of an order for a non-prefabricated product, manufactured according to the Consumer's specifications or intended to meet their individual needs, including in particular a product with properties individually specified by the Consumer, such as color or type of material from which the product is made. All products made and ordered to the Buyer's order are not returnable, and in particular, the right of withdrawal from the Contract does not apply to them.
  5. If the Buyer cancels an order for a non-prefabricated product within 2 days of the date of payment of the advance payment, the full amount will be refunded. If the Buyer cancels the order after 2 days from the date of payment, the deposit is non-refundable. The Buyer is obligated to return the item to the Seller or hand it over to a person authorized by the online store for collection immediately, but no later than 14 days from the date on which the Buyer withdrew from the contract. To meet the deadline, it is sufficient to return the item before its expiry. The Consumer is liable for any diminished value of the item resulting from use beyond what is necessary to establish the nature, characteristics, and functioning of the item.
  6. The money will be refunded within 14 (fourteen) days from the date of receipt of the consumer's declaration of withdrawal from the contract, provided that the Seller will withhold the refund of payments received from the Consumer until the goods are received back or the Consumer provides proof of sending back the goods, whichever occurs first.
  7. The Seller will refund the payment using the same payment method used by the Buyer, unless the Buyer has expressly agreed to a different refund method that does not involve any costs for the Buyer. (In the case of payment by card, the refund will be made to the payment card account used for payment).
  8. The Buyer may withdraw from the contract by submitting a declaration of withdrawal to the Seller. The declaration may be submitted on the form, a sample of which is attached as Appendix 1 to these Terms and Conditions.
  9. The Seller does not provide the option to submit a declaration of withdrawal from the contract electronically.
  10. The Buyer may return the item via the GLS courier company, whose addresses The Buyer can find here; in such a case, the shipping fee is covered by The Buyer. The Buyer only bears the direct costs of returning the item. Due to the size and weight of the goods, in the event of withdrawal from the contract, returning the goods may involve higher costs than standard postal delivery.

  12. Parcels sent to the Seller's address cash on delivery will not be accepted.

VIII. Confidentiality of personal data

INFORMATION CLAUSE WHEN COLLECTING DATA DIRECTLY FROM A PERSON

Pursuant to Art. 13 sec. 1 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as: GDPR), we inform you that:

U1, 02-699 Warsaw for the provision of offered services and the performance of this agreement, as well as for the performance of the Seller's legal obligations, direct marketing, creating reports, analyses and statistics, verifying payment credibility, handling complaints and notifications, technical support, financial settlements, including the issuance of accounting documents.


4) PRIMAVERA HOME Sp. z o.o. A Limited Joint-Stock Partnership, ul. Kłobucka 23 B lok. U1, 02-699 Warsaw, is authorized to transfer your personal data to third parties. Therefore, your personal data may be transferred to subcontractors under a personal data processing agreement. Your personal data is transferred based on the agreement you concluded and on the basis of mandatory provisions of law, including at the request of authorized courts, authorities, and institutions.


5) Your personal data is generally not transferred outside the EEA. However, your personal data may be transferred outside the EEA when it is necessary to perform your service, including when the performance of the service requires the participation of subcontractors based outside the EEA.

6) Your personal data will be stored for the duration of the contract you concluded by PRIMAVERA HOME Sp. z o.o. Spółka Komadymowo-Akcyjna, ul. Kłobucka 23 B lok. U1, 02-699 Warsaw, in connection with which your personal data are processed, and after this period until the expiry of the limitation period for claims arising from the contract concluded by you for the provision of services offered by the Seller. However, your personal data recorded in accounting documentation will be stored for the period specified in applicable law, including tax regulations.


7) Subject to the limitations resulting from the GDPR and other legal provisions, you have the right to access your personal data and the right to rectify, erase, limit processing, the right to transfer personal data, the right to object, and the right to withdraw consent at any time if processing is based on your consent.

8) You have the right to lodge a complaint with a supervisory authority within the meaning of the GDPR if you believe that the processing of your personal data violates the provisions of the GDPR.

9) To the extent necessary to perform the contract concluded by you with the Seller for the provision of the offered services, as well as to the extent necessary to take action at your request and to the extent necessary for the fulfillment by

However, to the extent that you have consented to the processing of your personal data solely for marketing purposes, providing your personal data is voluntary, but refusing or withdrawing consent will prevent the Seller from informing you about new offers and promotions.


10) You may be subject to a decision based solely on automated personal data processing, including profiling, if we are authorized to do so by applicable law or if you have previously consented thereto.




IX. Intellectual Property Rights

  1. All content of the e-store websites (illustrations, text, names, brands, photos, videos) is the property of the Seller. Any partial or complete reproduction of the content, by any means and on any medium, requires the prior and express consent of the Seller.
  2. All information, content, and software are protected by intellectual property rights and copyright. The Seller may grant the right to copy, display, or distribute the entire content of the website. Any unauthorized use of this content by third parties may be subject to legal proceedings.



X. Final Provisions

  1. The Seller, in the event that it is unable to fulfill its obligation due to even a temporary inability to provide a service with the properties ordered by the Buyer, may release itself from the obligation by providing a substitute service of the same quality and purpose and for the same price or remuneration, while informing the Buyer in writing of its right to refuse such service and withdraw from the contract, with the return of the goods at the Seller's expense.
  2. The information contained on the primavera-home.com store website does not constitute an offer within the meaning of the Civil Code. By placing an order using the mechanisms available on the primavera-home.com store website, the Customer makes an offer to purchase a specific product under the terms specified in the product description. After placing the order, the Customer receives an automatically generated email from PRIMAVERA HOME Sp. z o.o. Spółka Komadywo-Akcyjna, ul. Kłobucka 23 B lok. U1, 02-699 Warsaw, confirming the registration of the order. This email does not constitute a declaration of acceptance of the offer or conclusion of a sales contract. The sales contract is concluded after confirmation by PRIMAVERA HOME Sp. z o.o. Spółka Komadywo-Akcyjna, ul. Kłobucka 23 B lok. U1, 02-699 Warsaw, Poland, regarding product availability and acceptance of the Customer's order, which will be confirmed by a separate email or phone call after the order is completed.
  3. The Seller reserves the right to change prices and quantities of goods in the online store during the day, withdraw individual products from the offer, and introduce new goods. Changes in prices, parameters, delivery terms, etc. do not apply to placed and confirmed orders.
  4. The applicable law is Polish law, in particular: the Civil Code, and with respect to contracts concluded with consumers, the Act of 30 May 2014 on Consumer Rights (Journal of Laws 2014, item 827).
  5. The parties may pursue their claims in court, in mediation, or before an arbitration tribunal mutually agreed upon by the parties.



INFORMATION ON EXERCISING THE RIGHT OF WITHDRAWAL

  1. You have the right to withdraw from this contract within 14 days without giving any reason. This does not apply to the items specified in point 7, paragraph 5.
  2. The withdrawal period expires after 14 days from the date on which you or a third party other than the carrier and indicated by you came into possession of the item.   3. You may use the model withdrawal form attached to these Terms and Conditions, but this is not obligatory.
  4. The Seller does not provide the option of submitting a declaration of withdrawal from the contract electronically.
  5. To meet the withdrawal deadline, it is sufficient to send information concerning the exercise of your right of withdrawal before the expiry of the withdrawal deadline. from the contract.
  6. Consequences of withdrawal:


1) If you withdraw from this contract, we will reimburse to you all payments received from you, including the costs of delivery (with the exception of the additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us), immediately and in any event no later than 14 days from the day on which we are informed of your decision to exercise the right to withdraw from this contract.

2) We will make reimbursement using the same means of payment that you used in the initial transaction, unless you have expressly agreed to a different solution; In any case, you will not incur any fees in connection with this refund.
3) We may withhold the refund until we receive the item or until you provide us with proof of its return, whichever comes first.

4) You will have to bear the direct costs of returning the item.

DSA (Digital Services Act)

1) Primavera Home allows you to post user content, understood as an opinion or comment.

2) Content that is inconsistent with the Terms and Conditions – illegal content relating to situations that are prohibited by law or contrary to good manners.

This includes: content that is offensive, violates religious feelings, personal rights of third parties, or demonstrates a lack of respect for generally understood social norms and principles of social coexistence, racist, vulgar, promotes violence, contains pornographic, fascist, or discriminatory content, with sexual undertones, inappropriate for underage users, etc., but also content containing hate, vulgarity or commonly considered spam.

3) Any illegal content that does not comply with the regulations should be reported to the following email address: biuro@primavera-home.eu or via the form.

4) Content that does not comply with the regulations – illegal content will be removed by the website administrator.
